The Court granted final approval to the Anthem class action settlement, as amended, on August 15, 2018, and on August 16, 2018 entered judgment and awarded attorneys' fees and service awards. The “Effective Date” of the settlement occurred on October 25, 2018, following dismissal of all appeals of the Court’s orders. Settlement benefits are now being processed.
Fraud Resolution Services are now available to all Settlement Class Members. If you are an Anthem data breach Settlement Class Member who has suffered an identity fraud event, and would like assistance from a certified Fraud Resolution Specialist at Experian, click here for your Engagement Number, and then call Experian at (866) 579-2216 for assistance.
The deadline for Settlement Class Members to file claims for Out-of-Pocket costs was August 16, 2019. Payment for valid Out-of-Pocket costs claims will be processed and distributed on a rolling basis in the order the claims were received. Please allow several months for review and processing of your documented claim for Out-of-Pocket costs. If you received a letter stating that your Out-of-Pocket costs claim was deficient, you can find more information at the Deficient Claims FAQ link, here.
In addition to claims for Out-of-Pocket costs, Settlement Class Members were able to claim credit monitoring services provided by Experian, or an alternative cash payment (up to $50), instead of credit monitoring services. The deadline to submit a claim for credit monitoring services or the cash payment was July 19, 2018. Those benefits were distributed, by December 1, 2018, to class members who submitted timely and valid claim forms. If you chose to receive credit monitoring services by checking the “Credit Services” box on your valid and timely claim form, instructions to activate those services were sent to you by email. If you did not provide an email address with your claim, instructions were sent by U.S. mail to the mailing address you provided on your claim form. If you chose to receive cash compensation in lieu of credit services, a payment for $50 was sent to you via PayPal, if you filed your claim electronically and chose PayPal on your valid and timely claim form. If you did not choose PayPal on your claim form, a check for $50 was sent by U.S. mail to the mailing address you provided with your claim.
If you timely submitted your claim for credit monitoring services or alternative compensation, but you did not receive instructions to activate your credit monitoring, or a check for $50, by December 14, 2018, or if you timely submitted your claim for out of pocket costs by August 16, 2019 and have not received payment or a notice of deficiency by November 16, 2019, you may call 1-877-703-0745 for more information.
The Settlement Agreement has now been modified so that after the Settlement Fund pays for four years of Credit Monitoring and all of the other claims, costs, and fees described in the Settlement Agreement, any Settlement Funds remaining will be used:
